That's a plausible explanation though it doesn't make much sense why he would do that. By that point, he was already in league with Kabuto and knew of his Reanimation Jutsu and a resurrected Konan could have definitely proved a valuable pawn. And it's not like she had any Kekkei Genkai that could have fallen into Kabuto's hands. But whatevs :)

The rock Yugito is lying on is raised up from the ground. Konan's leg is resting on the ground behind the rock and so only a bit of her calf can be seen.

The only explanation I can think of is that after Tobi killed her, her body sunk to the deeps of the water in Amegakure, just like Jiraiya, thus making her unreachable.
I always wondered why Kabuto did not resurrect Konan. Great lesbian pic BTW!
